What is ESI Registration?
ESI Registration is the process of enrolling your establishment under the Employees' State Insurance Act, 1948, with the Employees' State Insurance Corporation (ESIC), a statutory body functioning under the Ministry of Labour and Employment, Government of India. The Code on Social Security, 2020 came into force on November 21, 2025, consolidating nine older laws, including the ESI Act, into one framework. On May 8, 2026, the Ministry notified the Social Security (Central) Rules, 2026 under G.S.R. 344(E), which formally operationalise ESI, EPF, gratuity, and maternity benefit provisions under the new Code.
One real procedural change came out of that notification. Employers now have to complete a new employee's ESI portal enrollment on or before their first day of joining, not just "before employment starts" in the loose sense the old rule allowed. What hasn't moved, despite plenty of speculation: the contribution rates and the wage ceiling. Industry bodies have been pushing to raise the ₹21,000 ceiling to ₹25,000 or ₹30,000 for a while now, and the Code gives the government power to do that without a fresh Act. No notification has actually changed it as of this writing. If someone tells you the rate or ceiling moved in 2026, check the Gazette before you believe it.
Most of this changes less than it sounds like it should for day-to-day compliance. Labour is a Concurrent List subject, so states still have to notify their own rules before the new framework shifts anything else on the ground for most private employers, and as of mid-2026, most states remain at the draft stage. Until a state finalises its rules, the existing ESIC process and registration mechanics continue under transitional provisions.
